If you are a legal heir or beneficiary of a Pag-ibig member who has died, you can claim Pag-ibig death benefits only if:

the Pag-ibig member has not claimed his/her Provident benefits when he/she was still alive.

If the Pag-ibig member has claimed his/her Provident benefits after he accumulated at least 240 contributions, or when he turned 60 years old, or when he retired, or when he was permanently disabled, there is No More Pag-ibig death benefits to be claimed by his legal heirs or beneficiaries, kasi nakuha na ng member ang kanyang savings at dividends from Pag-ibig noong siya ay nabubuhay pa.

Hindi kapareho sa SSS na separate ang SSS retirement benefit or death benefit (lump sum o pension) sa SSS funeral benefit.

Sa Pag-ibig Fund, walang death benefit o burial benefit o funeral benefit, kung nakuha na ng member ang kanyang Provident Benefits noong siya ay  nabubuhay pa.

Provident Benefits ang tawag sa final benefits na tatanggapin.

Naririnig nio siguro ang TAV, ito ay Total Accumulated Values, at ito ang total amount na tatanggapin.


Kapag member ang tatanggap ng Provident Benefits:

TAV = Total Savings or Contributions + Total Dividends


Kapag legal heir o beneficiary ang tatanggap ng Provident Benefits:

TAV = Total Savings or Contributions + Total Dividends + Death Benefit


Ang maximum Death Benefit ay 6,000 pesos.

Kapag active ang deceased member at the time of his/her death, meaning merong contributions around the time of his/her death, ang death benefit is 6,000 pesos, regardless of the TAV amount.

Kapag inactive ang member, at less than 6,000 pesos ang TAV, ang death benefit is equal to TAV.

Kapag inactive ang member, at 6,000 pesos or more ang kanyang TAV, death benefit is 6,000 pesos.

 

DOCUMENTS REQUIRED to FILE A DEATH BENEFIT CLAIM:

  • Application for Provident Benefits Claim  (Pag-ibig form)
  • Death Certificate of Pag-ibig member, issued by PSA (formerly NSO)
    If the member died abroad, the Certificate of Death issued
    abroad should be certified by the Philippine Consulate
    General or Philippine Embassy in the country where the
    member died.
  • Notarized Proof of Surviving Legal Heirs  (Pag-ibig form)
  • Notarized Affidavit of Guardianship  (Pag-ibig form)
    (if children are 18 years old and younger, or physically/mentally handicapped)
  • Birth certificates of all children, issued by PSA, if the member had children
  • Marriage Certificate, issued by PSA if member is married
  • Advisory on Marriage, issued by PSA, if member is married
    At PSA, fill up the CENOMAR form, and PSA will later give you an Advisory on Marriage. Dito makikita kung isa lang o more than one ang naging asawa ng member, or kung merong na-annul na marriage.
  • Certificate of No Marriage (CENOMAR), issued by PSA, if member is single
  • Birth certificate of member, if claimants are the parents, or if the siblings are also claimants because the parents are already deceased
  • Birth certificates of siblings, if the member was single and parents are already deceased, or if the member had a child but remained unmarried
  • Two valid ID cards of claimant
  • Other documents required by Pag-ibig Fund upon filing of claim (Funeral receipt may be required)

Who are the Legal Heirs or Beneficiaries of a Deceased Pag-ibig Member?

The Pag-ibig Fund Circular No. 380, entitled Amended Guidelines on Pag-ibig Fund Membership Termination, signed on May 12, 2017, states that:

In case of member’s death, the release of his provident benefit claims shall be in accordance with the laws on succession.

The laws on succession are contained in Section 5 of the New Civil Code of the Philippines.

Heirs of a Deceased Married Pag-ibig Member:

  1. If the couple has children, the spouse and the children are the legal heirs.
    If the deceased member has illegitimate children, these illegitimate children are also legal heirs.
  2. If the couple has no children, and there are no illegitimate children, the spouse and the parents of the deceased member are the legal heirs. 50% for the spouse; 50% for the parents
  3. If the couple has no children and there are no illegitimate children and no more parents, the spouse and the siblings of the deceased member are the legal heirs. 50% for the spouse; 50% for the siblings

Heirs of a Deceased Single Pag-ibig Member:

  1. If the deceased single member has no children and his/her parents are still alive, the parents are the legal heirs. Equal ang share ng father and mother. Pag isang parent na lang ang buhay, mapupunta lahat sa surviving parent .
  2. If the single member has kids and his/her parents are still alive, the children and the parents are the legal heirs. 50% for the kids; 50% for the parents.
  3. If the single member has no kids, no grandkids, no more parents and no more grandparents, and has siblings, the siblings will divide among themselves the benefits.

WHERE TO FILE YOUR CLAIM:

File your Provident benefit claim at the Pag-ibig branch where the Pag-ibig member or employer has remitted the most or latest contributions.

If the member had multiple employers, check if the member’s contributions are already consolidated in the branch where you are filing.

If the legal heirs or beneficiaries are unable to file the Pag-ibig Fund Death Benefit themselves, the claim can be filed by their authorized representative, their appointed court administrator or executor.

Any authorized representative is required to present a Special Power of Attorney (SPA), his or her valid IDs, and the valid IDs of the member and beneficiaries.
