Your Unfaithful Spouse Can Claim Your Pag-ibig Death Benefits

It’s so sad to know that your spouse who cheated on you, or who abandoned you, or who left you to support his or her new family can claim your Pag-ibig death benefits in case you die first.

Because the Pag-ibig charter does not consider situations such as separation, abandonment, and contracting of invalid second marriages when evaluating death benefit claims from the surviving spouse.

Basta ang surviving spouse ay merong PSA-issued and PSA-certified marriage certificate, kahit anong nangyari, kahit ang gumasto sa hospital o sa funeral ay yong mga magulang o kapatid o mga anak, puedeng maka-claim ang unfaithful spouse na wala man lang naitulong.

Ang claim ng spouse sa Pag-ibig ay ibang-iba sa claim ng spouse sa SSS.

Sa SSS, ang spouse na matagal nang hiwalay sa namatay na SSS member, o nakisama na sa iba ay hindi na makaka-claim ng SSS death benefit, basta mai-report ang sitwasyon sa SSS.

Sa Pag-ibig, makaka-claim pa rin ang matagal nang humiwalay na spouse dahil merong hawak na PSA-verified marriage certificate.

Meron nang mga nag-comment dito na nakapag-claim pa rin ang mga surviving spouses na nang-abandona.

In the IRR of the Pag-ibig Fund law, the term “Beneficiaries” is defined as below:Beneficiaries. Person or persons who are entitled to receive the member’s TAV arising from the death of the member who shall be the heirs, as provided for under the Civil Code of the Philippines, of said member.

Walang naka-attach na conditions sa “heirs”.

On Pag-ibig’s PROOF OF SURVIVING LEGAL HEIRS form, unang-una ang WIDOW o WIDOWER sa list of surviving legal heirs.a. Widow/Widower
b Children (Legitimate, Legally adopted, Acknowledged natural, or Illegitimate)
c. Parents
d. Paternal and maternal grandparents, if no children and no parents
e. Brothers and sisters, if no children, no parents, and no grandparents
f. Children of deceased brothers and sisters, if no children, no parents, no grandparents
g. Other relatives, if none of the above

Walang naka-attach na conditions sa “Widow/Widower”

Sa SSS Law, ang definition ng SPOUSE under BENEFICIARIES ay merong naka-attach na “DEPENDENT”.
Beneficiaries – The dependent spouse until he or she remarries.

Kelangang dependent pa rin ang surviving spouse doon sa SSS member prior to the member’s death.

Ano ang mga implications nito?

If your spouse has long abandoned you, and has never helped you and never supported you in raising your children, think about saving your money in the SSS Peso Fund or the SSS Flexi-Fund or other investment products in which benefits will go only to the beneficiaries that you will designate.
